Condiciones Generales a los servicios de transporte aéreo
De una parte, Global Travel Booking, S.L.U. con domicilio social en Calle Gran Vía,22 dup, 4º derecha, 28013, con NIF número B-76122639 (en adelante, Onlinetravel).
Y, de otra parte, el usuario, que accede a la página para informarse y contratar los servicios ofertados a través de la web y quien declara que es mayor de edad (es decir, tiene, al menos, 18 años) y dispone de la capacidad legal necesaria para vincularse por este acuerdo y para utilizar este sitio web de conformidad con el presente Aviso Legal y con las Condiciones Generales de cada tipo de servicio ofrecido en la web, las cuales declara que comprende y entiende en su totalidad.
1. Definiciones
Excepto cuando el contexto lo requiera, las siguientes definiciones tendrán el mismo significado que se indica a continuación, cualquiera que sea su propósito. Las definiciones son igualmente aplicables tanto si se mencionan en singular, como en plural.
– Billete/billete electrónico: se refiere al itinerario/recibo emitido por o en nombre del transportista contractual, los cupones electrónicos, y en su caso, un documento de embarque del que forman parte las presentes condiciones.
– Transportista contractual: todo transportista aéreo que transporte o se comprometa a transportar al pasajero y su equipaje en virtud del contrato de transporte aéreo.
– Transportista de hecho: otro transportista que realice parte o todo el transporte contratado con el transportista contractual y autorizado por éste.
– Convenio de Montreal: Convenio para la Unificación de ciertas Reglas para el Transporte Aéreo Internacional, firmado en Montreal el 28 de Mayo de 1999.
– Reglamento (CE) Nº 2027/97 del Consejo de 9 de Octubre de 1997, modificado por el Reglamento (CE) Nº 889/2002 de 13 de mayo de 2002, relativo a la responsabilidad de las compañías aéreas comunitarias respecto al transporte de pasajeros y su equipaje.
-Reglamento (CE) Nº 261/2004 del Parlamento europeo y del Consejo de 11 de febrero de 2004 por el que se establecen normas comunes sobre compensación y asistencia a los pasajeros aéreos en caso de denegación de embarque y de cancelación o gran retraso de los vuelos, y se deroga el Reglamento (CEE) nº 295/91
2. Normativa aplicable
El transporte realizado en virtud de un contrato formalizado a través de la web estará sujeto a las normas y limitaciones establecidas por los Convenios de Varsovia de 1929 y Convenio de Montreal, en sus sucesivas versiones vigentes en el momento de la reserva, a menos que el transporte no pueda considerarse transporte internacional, según la definición de dichos Convenios, en cuyo caso se estará a lo dispuesto por la legislación nacional aplicable. Siempre que no contravenga esta legislación, el transporte y demás servicios prestados por el transportista se regirán por las disposiciones que aparezcan en el billete aéreo; las tarifas aplicables; las condiciones de transporte establecidas por el transportista y las disposiciones que formen parte del presente contrato, a excepción del transporte realizado entre cualquier punto de Estados Unidos o Canadá y cualquier otro fuera de estos países, donde se aplicarán las normas vigentes en esos territorios.
3. Validez del título
El billete aéreo tiene una validez mínima de DOCE (12) meses desde su fecha de emisión, siempre que en el billete no se establezca un plazo distinto, en las condiciones de transporte, en los reglamentos que sean de aplicación, o en los manuales de tarifas de transportista.
4. Tarifa y condiciones
Los precios indicados en la web llevan incluidas las tasas aeroportuarias y se indicarán desglosadas cuando se hayan añadido a la tarifa del billete. Sin embargo, no incluyen todos aquellos gastos de visados ni de tasas de salida de un país o territorio.
Las tasas aeroportuarias pueden sufrir modificaciones con posterioridad a la fecha de compra del billete. Si se produce un incremento en una tasa o impuesto con posterioridad a la fecha de compra del billete, el pasajero deberá abonar la diferencia con respecto a las reflejadas en el momento de la compra. Si a causa de la demora o retraso en el pago de la reserva se produjesen modificaciones en la tarifa aplicable en las tasas de aeropuertos, serán repercutidas al usuario desde el momento de la reserva hasta la emisión del billete.
Con la finalidad de ofrecer siempre el mejor precio al usuario, se ofrecerán tarifas de ida y vuelta y tarifas de solo ida en reservas de ida y vuelta, es decir, se ofrecerán en una reserva de ida y vuelta un billete para la ida y otro billete para la vuelta independientes entre sí. Las condiciones de cancelación y modificación de estos billetes son independientes entre sí siendo aplicada la propia política de cambios y cancelaciones en cada trayecto y Compañía Aérea.
5. Documentación necesaria requerida para el vuelo
Los usuarios serán responsables de informarse y de estar en posesión de la documentación exigida por las leyes o autoridades de los países para poder volar al destino o en tránsito, así como del cumplimiento de los requisitos exigidos en cada caso por las autoridades gubernativas competentes (por ejemplo, vacunas), sin que sea posible, habiendo cumplido Online Travel su deber general de información, presentar reclamación alguna con motivo de la imposibilidad de llevar a cabo el vuelo contratado por no contar con la documentación o no cumplir con los requisitos exigidos por la autoridad gubernamental competente.
El usuario es el único responsable de obtener la tarjeta de embarque por los medios dados por las diferentes compañías aéreas, siendo el usuario el único responsable de elegir la opción más adecuada a cada situación. Determinadas aerolíneas, como Ryanair, Wizzair, AirBaltic…, exigen la emisión de la tarjeta de embarque por parte del usuario.
El usuario declara que conoce los requisitos gubernamentales de documentación, tanto de entrada, como de salida, y que cumplirá con lo por ellos dispuesto. Esta información puede encontrarse en la página web del Ministerio de Asuntos Exteriores Español o en el organismo que corresponda según la nacionalidad del usuario.
5.1. Vuelos domésticos o nacionales
Es obligatorio contar con un documento de identidad en todos los vuelos. Algunos vuelos nacionales pueden tener la consideración de vuelos internacionales, serie 6.000 de Iberia, por lo que los pasajeros deben ir provistos de documento de identidad/Pasaporte en vigor.
5.2. Vuelos internacionales
– En vuelos dentro del espacio Schengen, siempre que tenga nacionalidad de un país de la Unión Europea, y salvo que el Tratado no haya sido temporalmente suspendido, solo será necesario el documento nacional de identidad.
– Es necesario el documento nacional de identidad o Pasaporte, y además, dependiendo del destino, la obtención de Visado. En ningún caso será válida la tarjeta de residencia como único documento. Los ciudadanos españoles que posean un Pasaporte español en vigor, de lectura mecánica, podrán viajar a los Estados Unidos sin el correspondiente visado, gracias al Programa de Exención de Visados (Visa Waiver Program, V.W.P) a través del Sistema Electrónico para la Autorización del Viaje (Electronic System for Travel Authorization, E.S.T.A), que incluye los viajes en tránsito por el citado país. En los casos de Turquía y Australia, el viajero podrá gestionar su visado a través de la página www.evisa.gov.tr/ y /www.eta.immi.gov.au/ respectivamente.
5.3. Menores de edad
Los menores hasta 14 años que vuelen con sus padres deberán portar el Libro de Familia para poder identificar la relación con sus padres, así como, la documentación necesaria. Necesitarán el documento nacional de identidad en vuelos comunitarios (zona Schengen) y el Pasaporte (y visado si el país de destino así lo requiere) para vuelos internacionales y comunitarios que no apliquen el tratado de Schengen. A partir de 14 años deberán presentar la misma documentación que los pasajeros adultos. En cualquier caso, recomendamos revisar con cada compañía aérea, las previsiones en cuanto a la documentación requerida.
Para menores no acompañados, además de la documentación mencionada, los padres o tutores deberán presentar una autorización, y cumplimentar la documentación necesaria que la compañía aérea le requiera para aceptar al menor no acompañado. Se recomienda contactar con ellos para informarse de los requisitos necesarios.
Informamos que las compañías de bajo coste, (Ryanair, Easyjet, etc….), no aceptan transportar a menores de 18 años sin ir acompañados.
6. Reconfirmación de los horarios de salida del vuelo
Si así se estipula en las condiciones de transporte establecidas por el transportista, se recomienda que el usuario confirme con la compañía aérea, al menos con 24 horas de antelación a la salida del vuelo, los horarios de los mismos, ya que las aerolíneas pueden modificar el horario de salida y no existir tiempo suficiente para que Online Travel pueda comunicar esta modificación de último momento al usuario.
Asimismo, en el supuesto de vuelos especiales o chárter, los datos identificativos de la aerolínea, la clase de aeronave, horario, itinerario y posibles escalas son meramente indicativos y se recomienda al usuario confirmar los datos con anterioridad a la salida de su vuelo.
7. Equipaje
La facturación del equipaje que no sea de mano, debe hacerse en el mostrador asignado a la compañía aérea al efecto, donde se entregará al pasajero el talón de equipaje. El equipaje que haya sido facturado se entregará a aquella persona que aparezca como portadora del talón de equipaje.
La facturación del equipaje no siempre es desde el origen al destino final, lo que puede implicar que la maleta deba ser facturada de nuevo en el aeropuerto de conexión. La política con respecto a la facturación de maletas, depende tanto de la aerolínea (algunas aerolíneas, como Vueling, no facturan hasta destino final, si hay 2 escalas), como de los países/aeropuertos a los que se vuela, o por donde discurre el vuelo con escalas.
La compañía aérea está obligada a transportar el equipaje del pasajero aunque puede limitar el número de bultos o el peso máximo, y puede optar por cobrar una cantidad que deberá fijarse en el contrato de transporte. Le recomendamos que consulte con la compañía aérea antes de emprender su viaje sobre las condiciones de equipaje de mano permitido.
Cuando existan incidencias con su equipaje (daños, retrasos, pérdida) según el Convenio de Montreal, la compañía aérea es la única responsable del daño causado.
7.1. Incidencias con el equipaje (pérdida, daño, retraso)
En el supuesto de que su equipaje sufra una incidencia, le recomendamos que lo comunique antes de abandonar el aeropuerto, en los mostradores de la compañía aérea (o si ésta no tuviera presencia en el aeropuerto, a su agente handling o su representante). Cuando comunique la incidencia en el aeropuerto, la compañía aérea o su agente de handling, emitirán un parte de irregularidad de equipaje (PIR) y le entregarán una copia que deberán conservar.
Se debe presentar también una reclamación formal por escrito al transportista, a la que deberá adjuntar copia del PIR. Dicha reclamación debe efectuarse dentro de los plazos establecidos por el Convenio de Montreal:
Daños en el equipaje: En caso de que se hayan producido daños al equipaje, debe presentar la reclamación pertinente al transportista dentro de los 7 días siguientes a la fecha de entrega como máximo.
Retraso del equipaje: Si se produce retraso en la entrega del equipaje, la reclamación debe presentarse en los 21 días siguientes a la fecha en que debería haber recibido el mismo.
Pérdida del equipaje: El Convenio de Montreal no establece un plazo límite, aunque se recomienda realizar la reclamación lo antes posible, una vez hayan transcurrido los 21 días durante los cuales la maleta ha estado en situación de ?retraso, o tras la confirmación de la propia compañía aérea de que su equipaje está perdido.
7.2. Reclamador
OnlineTravel pone a disposición del usuario el servicio de Reclamador.es (.RECLAMADOR S.L., una sociedad con NIF B-86474012 y domicilio social en Madrid, calle Zurbano nº 76, 7º Izda., 28010, inscrita en el Registro Mercantil de Madrid, Hoja M-537869, folio 121, tomo 29888) para la tramitación de reclamaciones contra las compañías aéreas en nombre del usuario.
Reclamador.es tramita la reclamación en nombre del usuario.

8. Cancelaciones y reembolsos
8.1. OnlineTravel considera confirmadas, y por tanto, definitivas, aquellas reservas que aparezcan con su localizador, con el pago efectuado y los billetes emitidos.
8.2. En caso de cancelación de un vuelo o de retraso, se acogerá a lo dispuesto en la legislación aplicable. Si la compañía aérea cancela, retrasa o deniega el embarque a un usuario con un billete válidamente emitido o provoca la pérdida de un vuelo de conexión, siempre que la conexión sea objeto del contrato de transporte y aparezca como una prestación garantizada contratada por el usuario, éste podrá tener derecho a la obtención de una compensación en los términos previstos por la legislación aplicable.
Si se le presenta alguno de los problemas a los que se refiere el anterior párrafo, el usuario debe solicitar inmediatamente al representante de la compañía aérea encargada de efectuar el vuelo que trate de solucionarlo.
8.3. Si el usuario sufre una situación de denegación de embarque, anulación o retraso importante y la compañía aérea encargada de efectuar el vuelo no cumple sus obligaciones, el usuario debe de presentar una reclamación ante el organismo nacional competente que corresponda. Si su vuelo sale de un país de la Unión Europea, será en este estado donde deba realizarla. Si se viaja desde fuera de la Unión Europea en un vuelo operado por una compañía de la Unión Europea, la presentación se deberá de realizar en el país de la Unión Europea donde aterrice el vuelo. Para obtener el nombre y la dirección de la autoridad competente o informarse acerca de las organizaciones que le pueden asesorar o ayudar con otras reclamaciones (por ejemplo, equipajes, lesión corporal o muerte y viajes combinados), el usuario tiene a su disposición el número gratuito de Europe Direct (*): 00 800 67 89 10 11 o mediante el formulario de contacto disponible en la web http://europa.eu/europedirect/index_es.htm
8.4. Existen billetes, dentro de la oferta de OnlineTravel que son de tarifa no reembolsable, lo que significa que no admiten ningún tipo de devolución como consecuencia de cambio, modificación o cancelación de los mismos por parte del usuario. En este tipo de tarifas, el usuario acepta las condiciones de los billetes adquiridos a la compañía aérea y que no son reembolsables en ningún caso, por lo que éste no tendrá derecho al reembolso de las mismas.
Por este motivo, se recomienda al usuario la contratación de un Seguro de Cancelación en el momento de confirmación de la reserva.
8.5. Reservas efectuadas con compañías aéreas de bajo coste o low cost: Si bien OnlineTravel queda a su disposición, para los trámites dirigidos a la cancelación de estos billetes han de realizarse directamente por el usuario. En caso de cambios o cancelaciones por parte de la compañía aérea, ésta será la única responsable de dicho cambio o cancelación al ser OnlineTravel un mero intermediario.
9. Modificaciones o cancelaciones solicitadas por el usuario
9.1. Si un usuario solicita un cambio de fecha o cancelación de su reserva, éste será estudiado individualmente informándole de la política de cambio y cancelación específica de su reserva, y siempre bajo la consideración y aceptación de la compañía aérea. OnlineTravel cobrará CUARENTA euros (40 ?) por persona en concepto de gastos de tramitación por los cambios de fechas o cancelaciones. En ningún caso estos gastos de gestión serán reembolsables. Para las aerolíneas de bajo coste o low cost, en caso de que la reserva permita cambios, cancelaciones o solicitud de algún servicio especial es obligatorio que el cliente usuario contacte directamente con la compañía aérea ya que OnlineTravel no puede realizar ni peticiones, ni cambios, ni cancelaciones en los billetes de dichas compañías.
9.2. Para poder gestionar un cambio o cancelación OnlineTravel necesita tener la petición y la aceptación por el usuario de los gastos relacionados con el cambio o la cancelación, por escrito, y al por lo menos SETENTA Y DOS (72) horas antes de la salida. Para que la petición de cambio o cancelación se considere recibida deberá entregarse en horario laboral de 8 a 22 horas, de lunes a viernes y sábados de 9 a 18 horas, tomando como referencia horaria GMT (Greenwich Mean Time) + 1. En caso contrario, se entenderá recibida en el día siguiente hábil, siendo inhábiles los sábados desde las 18 horas y los domingos. En todo caso, los cambios o cancelaciones dependen de los proveedores finales de los servicios, por lo que se aconseja contactar con Online Travel y valorar en cada caso el plazo para realizar estos trámites y las condiciones.
9.3. Los datos introducidos en el momento de confirmar la compra (datos personales, vuelos seleccionados, etcétera) deben ser correctos puesto que toda modificación posterior podría conllevar la pérdida de la tarifa original, e implicar penalizaciones de las aerolíneas.
Si la reserva es errónea por haber facilitado el usuario datos incorrectos, debe ponerse en contacto con Online Travel a la mayor brevedad posible, con el fin de que se realicen las gestiones pertinentes con la aerolínea para tratar de minimizar los gastos, en su caso.
9.4 Online Travel cobrará DIEZ EUROS (10 ?) en concepto de gastos de gestión postventa por cualquiera de los trámites que, no estando incluidos en la prestación de transporte contratada, se soliciten con carácter posterior a la reserva. Con carácter no limitativo estos trámites podrán consistir en la gestión de tarjetas de embarque, adición de equipaje extra, gestiones con tarjetas de fidelización, u otros similares.
10. Seguro de cancelación
Online Travel ofrece al usuario la posibilidad de contratar un Seguro de Cancelación que permita, en su caso y bajo las condiciones y requisitos que se estipulen, la recuperación del importe de la reserva realizada. Online Travel recomienda la suscripción del mencionado seguro, que se hará efectivo en el momento de la confirmación de la reserva. Online Travel recomienda revisar las Condiciones Generales de la póliza con anterioridad a su contratación así como las exclusiones que puedan existir.
11. Descuento residente Balear/Canario/Ceuta y Melilla
Al marcar la casilla de residentes durante el proceso de reserva se mostrarán los precios con el descuento aplicado en caso de que la compañía aérea y los vuelos lo permitan, solicitándose el consentimiento del usuario para realizar la verificación de su condición de residente a través del sistema de acreditación de residencia automatizado (SARA).
La confirmación de la reserva queda supeditada al resultado de que dicha verificación sea ‘VERIFICADA’.
No se aplicará este descuento a billetes ya volados o confirmados sin este descuento. Es responsabilidad del usuario informarse, antes de solicitar un billete con descuento de residente, acerca de la documentación necesaria para esta bonificación y de si por su nacionalidad o situación legal puede optar a este descuento.
13. Descuentos por familia numerosa
En España, la Orden del Ministerio de Fomento 3837/2006, establece la bonificación de tarifas aéreas nacionales a miembros de Familias Numerosas. Esta bonificación puede ser acumulable con la que se realiza a los residentes en Canarias, Baleares, Ceuta y Melilla.
Para obtener la bonificación por familia numerosa, el usuario debe acreditar su condición de miembro de familia numerosa ante la compañía aérea, presentando el título oficial de familia numerosa o documento individual que hayan sido expedidos por la Comunidad Autónoma correspondiente y que se encuentren en vigor.
Durante el proceso de compra se solicitarán los datos necesarios para demostrar dicho derecho al descuento.
La comprobación de los documentos mencionados por el transportista, será realizada en el momento de facturación, previo al embarque y deberán presentarse los documentos acreditativos mencionados, con independencia de que el usuario disponga anticipadamente de la correspondiente tarjeta de embarque. Si el usuario no acredita su identidad, la condición de miembro de familia numerosa, o sus datos no coincidiesen con los del titular que figura en el billete, no podrá efectuar el viaje correspondiente con dicho billete.
13.1 Descuento de Residente y de familia numerosa con compañías de bajo coste o low cost
Este tipo de descuentos no son siempre aplicables en vuelos operados por Compañías Aéreas low cost o bajo coste. Por ello, para beneficiarse del descuento, deberá solicitarse información a Online Travel o realizar la reserva directamente con la compañía aérea.
14. Responsabilidad de las compañías aéreas en relación con los pasajeros y su equipaje
14.1. Indemnización en caso de muerte o lesión
Según la normativa aplicable, el transportista es responsable del daño causado en caso de muerte o de lesión corporal de un pasajero, al haberse producido el accidente que ha causado el daño a bordo de la aeronave, o durante cualquiera de las operaciones de embarque o desembarque. La compañía podría quedar, total o parcialmente, exonerada de su responsabilidad, si prueba que la negligencia u otra acción u omisión indebida del pasajero, causó el daño o contribuyó a él.
No hay límite económico fijado para la responsabilidad en caso de lesiones o muerte del pasajero. Para los daños de hasta un máximo de 100.000 DEG , el transportista no podrá impugnar las reclamaciones de indemnización. Por encima de dicha cantidad, la compañía aérea solo podrá impugnar una reclamación en caso de que pueda probar que no hubo de su parte negligencia ni falta de otro tipo, o bien que el daño se debió únicamente a la negligencia o a otra acción u omisión indebida de un tercero.
14.2. Anticipos en caso de muerte o lesión
En caso de muerte o lesión de un pasajero, la compañía aérea deberá abonar en el plazo de quince días, desde el día de la identificación de la persona con derecho a la indemnización, un anticipo para cubrir las necesidades económicas inmediatas. En caso de fallecimiento, este anticipo no podrá ser inferior a 16.000 DEG.
14.3. Retraso del equipaje
En caso de retraso del equipaje, la compañía aérea es responsable del daño, siempre que no haya tomado todas las medidas razonables para evitar el daño o le haya sido imposible tomar dichas medidas. La responsabilidad en caso de retraso del equipaje se limita a 1. 000 DEG.
14.4. Destrucción, pérdida o daños del equipaje
La compañía aérea es responsable en caso de destrucción, pérdida o daños del equipaje hasta la cantidad de 1.000 DEG. Con respecto al equipaje facturado, es responsable aun cuando esté exento de culpa, salvo que el equipaje ya estuviese dañado. Con respecto al equipaje no facturado, la compañía aérea solo es responsable de los daños causados por su culpa.
14.5. Límites más elevados para el equipaje
El pasajero puede acogerse a un límite de responsabilidad más elevado efectuando una declaración especial, a más tardar en el momento de facturar, y abonando una tarifa suplementaria.
14.6. Responsabilidad de la compañía con la que se ha contratado el servicio y la compañía encargada de la prestación efectiva
Si la compañía aérea encargada del vuelo no es la misma que la compañía aérea contratante, el pasajero podrá formular una queja o una reclamación a cualquiera de ellas. Si en el billete consta el nombre o el código de una compañía aérea, ésa es la compañía aérea contratante.
14.7. Plazos de reclamación
Toda reclamación ante un tribunal deberá presentarse en el plazo de 2 años, a partir de la llegada de la aeronave o del día en que la aeronave hubiese debido llegar.
14.8. Fundamento de la información
Las normas descritas se fundamentan en el Convenio de Montreal de 28 de mayo de 1999, desarrollado en la Comunidad por el Reglamento (CE) Nº 2027/97 (modificado por el Reglamento (CE) Nº 889/2002) y por la legislación nacional de los Estados miembros. Este aviso, requerido por el Reglamento de la Unión Europea (EC) 889/2002, no podrá usarse para fundamentar una reclamación de indemnización ni para interpretar las disposiciones del Reglamento, ni las del Convenio de Montreal.
14.9. Derechos de los pasajeros en caso de denegación de embarque, anulación de vuelo y grandes retrasos
El artículo 5 del Reglamento (CE) 261/2.004, establece que si se deniega el embarque o si el vuelo se anula, la compañía encargada de efectuar el vuelo está obligada a indemnizar al pasajero y a prestarle asistencia. Siempre que haya efectuado la facturación en el plazo debido, pueden acogerse a estos derechos para cualquier vuelo, incluidos los chárter:
a. Los pasajeros partan de un aeropuerto situado en el territorio de un Estado miembro de la UE sujeto a las disposiciones del tratado.
b. Los pasajeros partan de un aeropuerto situado en un tercer país con destino a otro situado en el territorio de un Estado miembro de la UE sujeto a las disposiciones del tratado, a menos que disfruten de beneficios o compensación y de asistencia en ese tercer país, cuando el transportista aéreo encargado de efectuar el vuelo en cuestión sea un transportista comunitario.
14.10. Denegación de embarque
Cuando el número de pasajeros supere al de plazas disponibles, la compañía aérea deberá en primer lugar, pedir que se presenten voluntarios que renuncien a sus asientos a cambio de ciertas compensaciones, entre las que deben figurar incluidos el reembolso del importe del billete (con un billete gratuito de vuelta al primer punto de partida, si procede) o la oferta de transporte alternativo hasta el destino final.
Si no se ha presentado voluntario, la compañía deberá pagar al pasajero una compensación de 250 Euros para vuelos de menos de 1 500 kilómetros; 400 Euros para vuelos de más de 1.500 kilómetros efectuados en el interior de la Unión Europea y otros vuelos extracomunitarios comprendidos entre 1.500 y 3.500 kilómetros; y 600 Euros para los vuelos de más de 3 500 kilómetros efectuados fuera de la Unión Europea. La compensación podrá reducirse a la mitad si el retraso en el transporte alternativo no es superior a 2, 3 o 4 horas, respectivamente.
La aerolínea está obligada a dar a elegir al pasajero entre la devolución del importe del billete (junto con un billete gratuito de vuelta al primer punto de partida, si procede) o un medio de transporte alternativo hasta su destino final, y a ofrecerle gratuitamente comida y bebida suficientes, alojamiento en un hotel cuando sea preciso (incluidos los desplazamientos), así como a facilitarle medios de comunicación.
14.11. Anulación de vuelos
En el supuesto de que el vuelo sea suspendido, la compañía aérea encargada de efectuarlo deberá darle a elegir al pasajero entre la devolución del importe del billete (junto con un billete gratuito de vuelta al primer punto de partida, si procede), o un medio de transporte alternativo hasta su destino final, y a ofrecerle gratuitamente comida y bebida suficientes, alojamiento en un hotel cuando sea preciso (incluidos los desplazamientos), así como a facilitarle medios de comunicación.
La compañía aérea puede tener que compensarle también, en cantidades iguales a las debidas en caso de denegación de embarque, a no ser que le haya comunicado la anulación con la suficiente antelación y le ofrezca transporte alternativo en un horario próximo al previsto inicialmente.
La compensación o las devoluciones se pagarán en metálico, por transferencia bancaria o cheque o, previo acuerdo firmado por el pasajero, en bonos de viaje, y se harán efectivas en el plazo de 7 días.
Si se le niegan estos derechos, el usuario debe presentar una reclamación ante la compañía operadora del vuelo.
14.12. Grandes retrasos
Asistencia inmediata: Si el pasajero efectúa la facturación en el plazo debido para cualquier vuelo, incluidos los chárter, con salida de un aeropuerto de la Unión Europea o con destino a un aeropuerto de la Unión Europea desde otro situado fuera de ella si el vuelo lo opera una compañía comunitaria, y si la compañía que opera el vuelo prevé un retraso de 2 horas o más para los vuelos de menos de 1500 Kilómetros; de 3 horas o más para vuelos de más de 1.500 Kilómetros efectuados dentro de la Unión Europea y para otros vuelos de entre 1 500 y 3 500 Kilómetros o de 4 horas o más para los vuelos de más de 3 500 Kilómetros efectuados fuera de la Unión Europea, la compañía está obligada a ofrecerle comida y bebida suficientes, alojamiento en un hotel cuando sea preciso (incluidos los desplazamientos), así como a facilitarle medios de comunicación.
Cuando el retraso sea de 5 horas o más, la compañía tiene que ofrecer también al usuario la devolución del importe del billete (junto con un billete gratuito de vuelta al primer punto de partida, si procede).
Si se le niegan estos derechos, el usuario debe presentar una reclamación ante la compañía operadora del vuelo.
Reclamaciones posteriores: Si la responsable del retraso de un vuelo en cualquier parte del mundo es una compañía de la UE, el usuario puede reclamar hasta 4 150 DEG por los perjuicios ocasionados. Si la compañía no está conforme con la reclamación, puede usted recurrir a los tribunales.
El usuario puede reclamar ante la compañía con la que haya contratado su viaje, o ante la que opera el vuelo, si no son la misma.
Responsabilidades: Toda limitación o exclusión de responsabilidad del transportista se aplicará a sus agentes, representantes y empleados, así como a cualquier otra persona cuya aeronave utilice el transportista para el transporte, y sus representantes, agentes y empleados.
Las disposiciones del contrato de transporte vinculan a todo agente, empleado o representante del transportista, quienes no gozan de autoridad para modificar o renunciar a ellas.
Online Travel no se hace responsable de las reservas duplicadas que el usuario pudiera realizar. Tampoco se harán responsables de las reservas imposibles, por ejemplo, que un mismo pasajero vuele en el mismo momento a diferentes lugares.
15. Billetes aéreos impagados
Si la tarjeta de crédito del Uusuario es rechazada o denegada para el cobro de los billetes aéreos reservados por cualquier causa, en cuya venta Online Travel actúa como intermediario, la reserva podrá ser cancelada sin preaviso por la línea aérea.
Si se produce una devolución, anulación o rechazo, parcial o total, de los cargos realizados en la tarjeta de crédito, Online Travel tendrá derecho a cargar una comisión por reclamación de impago, al haber emitido y pagado los billetes aéreos.
16. Obligaciones del usuario.
El pasajero está obligado a llegar al aeropuerto a la hora fijada por las compañías aéreas o con la anticipación suficiente como para realizar con tiempo todos los trámites previos al vuelo y en cualquier caso, al menos una hora y media para vuelos nacionales y dos horas para los internacionales. Online Travel no será responsable de la falta de cumplimiento por el usuario de esta previsión.
17. Conexiones
En caso de efectuarse conexiones, el usuario debe saber que existen una serie de tiempos mínimos de conexión que se deben respetar. Si los cumple y a pesar de ello pierde su vuelo de conexión, la compañía aérea se hará responsable de embarcarle en el primer vuelo disponible, a no ser que el pasajero posea algún tipo de billete con restricciones. Cuando lo que se efectúa son conexiones con aviones de una misma aerolínea y se pierden por culpa de la compañía aérea, ésta se hará responsable en el 100% de los casos.
Se recomienda que el usuario pregunte a Online Travel sobre el tiempo mínimo de conexión y que vuele siempre con un margen prudencialmente suficiente.
Online Travel muestra vuelos con conexiones que respetan los tiempos mínimos de conexión establecidos por cada aeropuerto. Estos tiempos mínimos de cada aeropuerto están establecidos en función de conexiones entre aviones sin tener en cuenta equipaje facturado, es decir, que las conexiones están garantizadas siempre que no haya que recoger maleta en el aeropuerto de conexión y volver a facturar. En caso de necesitar facturar maleta durante el recorrido, deben observarse tiempos de conexión superiores a 2 horas.
Es responsabilidad del usuario no enlazar vuelos que no tengan, al menos, un período para efectuar la conexión igual al señalado en el párrafo anterior. Hacerlo supone tomar un riesgo que no puede ser controlado o minimizado por Online Travel.
En algunas ocasiones las compañías aéreas ofrecen vuelos directos con paradas técnicas en un punto diferente al origen y destino final. Estas paradas se pueden deber a cambio de avión, recogida de más pasajeros o cualquier cuestión técnica. Online Travel le informará de estas paradas siempre y cuando la compañía aérea facilite esta información. En ninguno de los casos, Online Travel se hará responsable de las molestias ni perjuicios ocasionados.
18. Servicios especiales requeridos por el usuario
Si el usuario necesita confirmar cualquier tipo de servicio especial como silla de ruedas, animal en cabina/bodega o algún tipo de comida especial, tendrá que indicarlo en el campo de OBSERVACIONES. En el caso de dificultades de movilidad, habrá que indicar el tipo de servicio que necesita, si puede o no subir escaleras, etc. En caso de animales, tipo de animal, medidas del transportín y peso total de ambos.
19. Responsabilidades de Online Travel
Online Travel, como titular legal de este sitio web, ofrece distintos servicios de transporte aéreo al usuario, actuando en nombre y por cuenta de transportistas aéreos. En ningún caso podrá interpretarse la explotación de esta web como un instrumento para la venta directa y en nombre propio de dichos servicios, actuando Online Travel como agente intermediario en todo caso.

En caso de realizar una reserva con una compañía de bajo coste o low cost, la moneda de pago será siempre la del país de salida del trayecto aéreo, aplicándose, en su caso, el tipo de cambio de la entidad bancaria desde la que se realice el pago.
Los precios se indican en diferentes divisas, si bien el cargo para el supuesto de contratación de alguno de los servicios, se realizará en euros (EUR), Dólares Estadounidenses (USD), o Libras (GBP) según la moneda de pago seleccionada por el usuario. No obstante, en algunos casos de utilización de pasarelas de pago seguras, se ofrece al usuario la posibilidad de elegir si desea también su cargo en cualquier otra divisa.
Se podrán pagar mediante Paypal todos los productos ofrecidos online excepto los cruceros, el alquiler de coche, algunos hoteles que solo admiten pago en recepción y algunos vuelos donde la aerolínea solo acepta pago por tarjeta de crédito.
En caso de realizar una reserva con una compañía de bajo coste o low cost la moneda de pago será siempre la del país de salida del trayecto aéreo.
